Hello Me – End User License Agreement (EULA)

This End User License Agreement (“EULA” or “Terms”) is a binding agreement between you (the user) and HelloMe (“Application Provider,” “we,” “us,” or “our”). These Terms govern your use of the HelloMe application (the “App”), including any updates or additional services, unless accompanied by a separate agreement. For iOS apps, the license to use the App is granted by Apple Inc. (“Apple”), subject to these Terms and Apple’s App Store policies. For other platforms, the license is granted by HelloMe. Please read these Terms carefully, as they explain your rights, obligations, and restrictions, including how we handle data and resolve disputes. Our Privacy Policy, available at https://hellome.ink/privacy, is incorporated into this agreement.

Auto-Renewable Subscriptions

HelloMe offers auto-renewable subscriptions available on a monthly or yearly basis. The subscription title, duration, and price (including price per unit, if applicable) are clearly displayed within the App or the respective app store (e.g., Apple App Store, Google Play Store) before purchase. Subscriptions automatically renew unless cancelled through your app store account settings at least 24 hours before the renewal date. You may manage or cancel subscriptions directly via your app store account.

License and Subscriptions

When you download the HelloMe App, you receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices linked to your Apple ID or Google account, subject to these Terms and the usage rules of the applicable app store (“Usage Rules”). You may not distribute or make the App available over a network for use by multiple devices simultaneously, nor may you transfer, redistribute, or sublicense the App.

Subscriptions (monthly or yearly) or bundled purchases unlock enhanced features, such as backups, syncing, unlimited journal entries, or exclusive content. Pricing and available features are displayed before purchase. All purchases are final, and no refunds are provided. By purchasing, you waive any right to withdraw and agree to immediate delivery of the service. If you sell your device, you must remove the App before transferring ownership.

App Updates

We may update the App at any time to address legal requirements, improve functionality, or fix bugs. Updates may be installed manually or automatically, depending on your device settings. You are not obligated to install updates, but older versions may no longer be supported, which could affect functionality. If you disagree with changes, you may stop using the App.

Ownership and Usage Restrictions

All content within the App—including but not limited to quotes, designs, code, sounds, images, and other materials—is owned by HelloMe or our licensors and protected by intellectual property laws. You are granted a limited license to use this content solely for personal, non-commercial purposes as permitted by these Terms and the Usage Rules. You may not:

Violation of these restrictions may result in account suspension or termination and, for iOS apps, is subject to Apple’s App Store policies.

Your Content

You may upload content to the App, such as journal entries, mood trackers, photos, or other data (“User Content”). By uploading User Content, you grant HelloMe a non-exclusive, worldwide, royalty-free license to use, store, and process this content to operate and improve the App’s functionality (e.g., backups, syncing, or feature enhancements). We will not sell your personal data. You agree not to upload content that is illegal, harmful, or infringes on third-party rights. We reserve the right to remove User Content that violates these Terms and may suspend or terminate your account if necessary. You are responsible for any legal claims arising from your User Content and agree to indemnify HelloMe for any related costs or liabilities.

Our Commitments

We commit to complying with applicable consumer laws, including Danish consumer law, and ensuring the App functions as described, meeting the standard quality expected of similar apps. For iOS apps, Apple’s App Store policies also apply.

Disclaimers

We do not guarantee that the App will be uninterrupted, error-free, or free from malware or security risks. We do not promise specific mental health or productivity improvements from using the App. The App’s availability and features may change without notice, and we are not liable for any resulting issues. You use the App at your own risk, particularly if relied upon for critical purposes.

Health Disclaimer: The App is designed for general support and reflection, not as a substitute for professional medical or therapeutic advice. Do not delay seeking professional help due to information or features provided by the App.

Limitation of Liability

To the maximum extent permitted by law, HelloMe and, for iOS apps, Apple, are not liable for personal injury, lost data, lost profits, business interruption, or other indirect or consequential damages arising from your use of or inability to use the App, unless caused by our gross negligence or intentional misconduct. In no event shall our total liability exceed fifty dollars ($50.00), except as required by applicable law. If you misuse the App or rely on it beyond its intended purpose, we are not responsible for any resulting harm. Some jurisdictions may not allow certain limitations, so these may not apply to you.

Dispute Resolution

If you have concerns, please contact us at support@hellome.ink. If we cannot resolve the issue, disputes will be handled through arbitration in Copenhagen, Denmark, under Danish law, except for EU residents, who may also use the EU’s online dispute resolution platform (http://ec.europa.eu/odr). Danish courts have final jurisdiction over legal matters. For iOS apps, disputes may also be subject to Apple’s App Store policies.

Device Support

The App may not be compatible with all devices. Check the Apple App Store or Google Play Store listing for supported devices. These Terms apply across all platforms (e.g., phone, tablet, web).

Payment Issues

Failure to pay for a subscription may result in downgraded access to the free version or account suspension. If you cancel a subscription, you retain access until the current billing period ends, after which you revert to the free version.

Termination

You may stop using the App and delete your account at any time by cancelling your subscription (if applicable) and uninstalling the App. We may terminate your license if you violate these Terms or if we discontinue the App, with reasonable notice where feasible. Upon termination, you must cease using the App and delete it from your devices. For iOS apps, termination is also subject to Apple’s App Store policies.

Export Compliance

You may not use or export the App except as permitted by United States law, Danish law, and the laws of the jurisdiction where the App was obtained. The App may not be exported to U.S.-embargoed countries or to individuals on the U.S. Treasury Department’s Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the App, you represent that you are not located in such a country or on such a list.

U.S. Government Use

The App and related documentation are “Commercial Items” as defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation.” For U.S. Government end users, the App is licensed only as a Commercial Item with the rights granted to all other users under these Terms.

Changes to These Terms

We may update these Terms to reflect legal changes, new features, or improved clarity. Significant changes will be communicated via email, in-app notifications, or on our website (https://hellome.ink/terms). Continued use of the App after changes constitutes acceptance of the updated Terms. If you disagree, you must stop using the App. Check the “Last Updated” date above for the latest version.
